Terms of Use

1. About Indicon and these terms

Indicon is operated by ARKADE CLUB PRIVATE LIMITED, India (“Indicon”, “we”, “us” or “our”). These terms cover the Indicon iOS and iPadOS app, its handwriting keyboard extension, writing and note features, and related support services (the “Service”). Our contact details are in section 12.

Please read these terms before using Indicon or making a purchase. They describe the conditions on which we offer the Service. Any acceptance required by law must be obtained in the appropriate way. The description and price presented for a purchase also form part of that purchase agreement. Nothing here takes away rights that the law gives you and does not allow us to exclude.

The licence for an App Store download is governed by Apple’s Standard End User License Agreement, unless the App Store listing supplies a different applicable licence. These terms supplement that licence for our Service. Apple’s agreement is available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/.

2. Eligibility and device access

You must be legally permitted to use the Service. If you are not old enough to enter into this agreement independently, a parent or legal guardian must authorise your use and purchases where permitted by law. This does not replace any separate parental consent required for personal-data processing.

Indicon does not require an Indicon account. You are responsible for maintaining appropriate security on devices you control and for purchases you authorise through your Apple account. A device’s App Store age rating is not a substitute for legal capacity or any required parental consent.

3. Handwriting, keyboard and language features

Indicon lets you write by hand, receive text suggestions in supported languages, insert selected text into other apps, and create and share notes. Available features depend on your device, operating system, language and app version.

The keyboard uses online handwriting recognition. It requires an internet connection and Apple’s Allow Full Access setting. Recognition requests can be sent automatically when you pause writing; they are not limited to moments when you choose a suggestion. Requests send your handwriting strokes and related recognition information to Google. Our Privacy Policy explains the information involved.

The app’s own handwriting canvas uses on-device recognition after the appropriate language model has downloaded. Downloads require internet access and can use mobile data. Installing an offline app model does not make recognition in the keyboard extension work offline. Some languages support writing and saved ink without text recognition. App and keyboard recognition may produce different results.

The keyboard can use limited surrounding text provided by the host app for local spacing and punctuation. When you insert text, the receiving app handles it under its own terms and privacy practices. Some apps or input fields may not allow third-party keyboards.

Recognition can make mistakes, omit characters or suggest unintended words. Review text before inserting, sending or relying on it, especially for names, numbers or important instructions. Indicon is a writing aid and does not guarantee an exact transcription. Network failures, provider changes or operating-system restrictions can interrupt recognition. These limitations do not remove our responsibility to provide the Service as agreed or any remedy required by law.

4. Your writing, notes and sharing

You retain the rights you have in your handwriting, notes and other content. You authorise processing necessary to perform the functions you request, such as recognising strokes, saving notes on your device and preparing an export. You do not transfer ownership of your writing to us.

Only enter, process or share information that you are entitled to use. In particular, consider other people’s privacy before including their personal information in an online recognition request, note or support message. Use an appropriate input method for passwords and other confidential information that you do not want sent for online recognition.

Indicon saves notes on your device. It does not provide an Indicon account-based note backup or cross-device synchronisation service. Device backups may contain app data depending on your Apple settings. Keep separate copies of important writing using the available sharing functions. Deleting the app, losing the device or a storage failure can make local notes unavailable; we may not have a copy to recover for you.

When you share text or a handwriting image, the app or recipient you select receives it. Removing the original note does not remove copies you have shared, saved elsewhere or included in backups. Our obligations concerning defective software or unlawful loss of data remain unaffected.

5. Optional support purchases

Indicon offers optional one-time support purchases where available. Each support purchase is a consumable contribution to support development. It does not renew automatically and does not unlock a paid subscription, permanent Pro access or additional features. You may make another contribution separately if you wish.

The available amount, currency and any applicable tax are shown in the app and Apple’s purchase confirmation. Confirm the amount before approving a purchase. Apple processes payment using your Apple account. RevenueCat helps us validate transactions and maintain purchase information.

A support purchase is not an investment, ownership interest, loan, charitable tax receipt or promise to deliver a particular future feature. Choosing not to contribute does not remove access to the current free features. A contribution does not guarantee that every feature will remain available indefinitely.

Consumable support purchases cannot be restored as reusable purchases or transferred into a premium entitlement. This limitation does not prevent you from requesting help with an incorrect charge or exercising refund rights. Keep your Apple receipt if you need purchase support.

For an Apple refund request, use https://reportaproblem.apple.com/. You can also contact us to explain a purchase problem. Apple’s refund process and any rights under applicable consumer law continue to apply; these terms do not impose a blanket “no refunds” rule. Deleting Indicon does not automatically refund a completed support purchase. These support purchases have no subscription renewal to cancel.

6. Acceptable use and software rights

You may use Indicon for lawful writing, including personal, educational and professional writing, subject to the applicable app licence. We and our licensors retain ownership of the software, design, branding and other materials we supply. Your own writing remains yours.

Do not interfere with the Service, distribute malicious software through it, bypass security or payment controls, or automate requests in a way that abuses recognition services. Do not use Indicon to violate another person’s rights. Restrictions on copying or reverse engineering do not override permissions under open-source licences or mandatory legal exceptions.

Third-party names and marks belong to their owners. Use of Apple, Google or RevenueCat technology does not imply that those companies endorse Indicon.

7. Privacy and third-party services

Our Privacy Policy describes local storage, online handwriting recognition, analytics, crash reporting, purchase processing and support communications. Allow Full Access is a system permission; it is not blanket consent for unrelated processing. Accepting these terms does not replace separate consent wherever that is legally required.

You can disable Full Access or remove the keyboard in your device settings. Online keyboard recognition will then be unavailable. Turning off Full Access does not turn off analytics, diagnostics or purchase services in the main app.

External websites, app stores, messaging services and apps you choose to open have their own terms. Their involvement does not remove our responsibilities for the Service or for providers acting on our behalf.

8. Changes, availability and ending use

We may update Indicon to improve it, fix faults, maintain security, meet legal requirements or accommodate changes in devices and recognition providers. We will honour binding purchase commitments and applicable duties to provide updates. Language and third-party service availability can change.

For material changes to these terms, we will provide appropriate notice and obtain agreement where required. Revised terms will not retrospectively remove rights arising from an earlier purchase. Any discontinuation is subject to legally required notice and remedies.

You can stop using Indicon, remove its keyboard and delete the app at any time. Export writing you want to retain first. There is no Indicon user account to close. Requests relating to provider or support records are addressed in the Privacy Policy.

We may restrict access to online services where reasonably necessary to address serious misuse, security risks or legal obligations. Where appropriate and lawful, we will explain the restriction and provide a way to challenge it through support. Ending use does not extinguish existing claims or statutory rights.

9. Our responsibilities

We will exercise reasonable care and skill in providing Indicon. We do not promise that recognition will always be correct, that the Service will never be interrupted or that local data cannot be lost. We remain responsible for meeting applicable quality, security and consumer-protection obligations.

To the extent the law allows, we are not liable for losses that could not reasonably have been anticipated from a breach. We do not exclude liability for fraud, deliberate wrongdoing, injury caused by negligence where liability cannot be excluded, or any other liability that the law makes non-excludable. Your statutory rights concerning personal data, faulty digital services and refunds remain intact.

10. Consumer rights

Consumers retain all mandatory protections in their country. Where European distance-contract rules apply, a qualifying purchase generally has a 14-day withdrawal period. Exceptions for immediate digital supply or fully performed services apply only when their legal conditions, including required express consent and acknowledgment, have been met. Opening the app or accepting these terms alone does not waive withdrawal rights.

Send a withdrawal notice to the seller identified on your receipt using its available procedure. If the contract is with us, email support@arkade.club with a clear statement of withdrawal, your name, address, purchase date and order reference. We can help identify the appropriate route. Applicable rights to correction, a price reduction or reimbursement for non-conforming digital content or services also remain available.

11. Law and disputes

These terms are governed by Indian law, while preserving any mandatory protections applicable where you live. No provision requires a consumer to give up a court or regulator available under mandatory local law. These terms do not require mandatory arbitration or a class-action waiver.

Please contact us if something goes wrong so we can try to resolve it. Doing so is not a condition for exercising statutory rights and does not extend a legal deadline. If a provision cannot lawfully be enforced, the remaining provisions apply only to the extent they can validly stand on their own.
